To be honest, I really like Justice Scalia as a judge. He's articulate, his legal opinions are interesting to read, and in terms of pure intelligence, he is probably the most impressive of the current nine. I agree with a lot of his philosophy about statutory and Constitutional interpretation (i.e., that courts should pay more attention to what a statute or constitutional provision actually says, and less attention to the legislative history of the statute or Constitutional provision). I also happen to agree (at least partly) with his views on the particular issue he was discussing in this speech: while I would hope that we (who claim to be the nation of truth, justice and all that jazz) would give some form of due process to prisoners of war, I do not believe they are "entitled" to any such process under the U.S. Constitution.

Having said all of that -- Justice Scalia is a Supreme Court justice. Why can't this man, who is so much smarter than most of us in so many ways, learn to keep his mouth shut about things he shouldn't be discussing publicly? This is at least the third time he's done this in very recent history, and it's getting extremely tiresome...

I agree - both with your opinion and Scalia's. He is articulate, interesting, well-spoken, fair and probably the best justice on the bench right now, but he needs to shut his piehole closed, even if what he speaks rings true.
